New cable TV tariffs for commercial subscribers

The Telecom Regulatory Authority of India (TRAI) has issued new tariff orders for broadcasting and cable television services in CAS notified areas and non-CAS area with respect to commercial subscribers.

According to the new order, commercial establishments have been divided into two categories. While the first consists of heritage hotels and hotels with a grading of 3 star and above, smaller hotels, motels and inns make up for the second category of commercial establishments. The latter, says the TRAI order, is to be charged like any ordinary cable subscriber in CAS and non-CAS areas.

TRAI has, however, allowed hotels in the first category to mutually negotiate the tariff of pay channels and the rental for set-top box in both CAS and non-CAS. However, to ensure that these starred hotels are allowed a choice of individual channels, the bouquets offered to this category will be subject to certain restrictions on maximum bouquet price in relation to sum of individual channel prices.

The order also states that tariffs for commercial cable subscriber showing programmes of a broadcaster to an audience of 50 or more persons at special events at a place that is registered under entertainment tax act, will also have to be mutually decided between the parties concerned.

The hotel associations had appealed in the Supreme Court against an earlier judgment from Telecom Disputes Settlement and Appellate Tribunal.
