Trademark issue: Honda Motors sues TVS Motor

HONDA Motors has filed a suit against TVS Motor for alleged infringing of the `City' trademark, which was used by TVS in its product `Star City', in the court of Mr Justice K.J. Sengupta of the Calcutta High Court.

Honda Giken Logyo Kabushiki Kaisha, popularly known as Honda Motors Ltd of Tokyo Japan, filed the suit against TVS Motor asking for temporary injunction, arguing that the mark `City,' due to its extensive use throughout the world, was a well-known trademark.

Without passing any interim order, Mr Justice Sengupta directed the parties to file affidavits fixing the matter to be posted in April 2006. The court directed TVS to keep a separate sales statement month by month.
