Transparent film imports from China may invite dumping duty

The Designated Authority in the Commerce Ministry has recommended imposition of definitive anti-dumping duty on imported cellophane transparent film (CTF) originating in or exported from China.

Transparent film is a re-generated cellulose film of glass clear transparency and sparkle. It is flexible but tough and withstands all the beatings in an automatic packaging operation and is made of wood pulp and is non-toxic and biodegradable.

Following a written petition filed by Kesoram Rayon, unit of Kesoram Industries, Kolkata on behalf of domestic industry, the Authority initiated an anti-dumping preliminary inquiry and recommended provisional anti-dumping duty of the subject goods from China.

After the preliminary investigations, a disclosure statement by domestic user/importer of the material demanded that the product under consideration should be restricted to plain/uncoated cellophane transparent film from 25 GSM to 40 GSM.

But the Authority said that the interested parties have not been able to establish that CTF above and below 25 GSM are different products.

After weighing the issues raised by the petitioner and also importers/users threadbare, the Authority said the subject goods originating in or exported from China have been exported to India below its normal value resulting in dumping.

The domestic industry has suffered material injury and hence it is proposed that definitive anti-dumping duties be imposed. Accordingly, the final anti-dumping duty on CTF exported from China would be $1.91 per kilogram.

Meanwhile, in another notification issued recently, the Authority has initiated mid-term review probe concerning anti-dumping duty in force involving the imports of phenol from Singapore, South Africa and European Union. The review has been prompted by the fact that the definitive anti-dumping duty on the subject goods was slapped on March 24, 2003 and it was more than two and a half years when the review needs to be in place to continue or discontinue with the anti-dumping duty.
