New Delhi , June 28 In a move that could put more pressure on H-1B visa-holding Indians, Programmers Guild, which advocates for the interests of US computer programmers and tech workers, has filed complaints against 300 companies this year, alleging that their `help wanted' advertisements discriminated against Americans and denied US workers equal access to jobs. "These actions are being filed with the US Department of Justice, Office of Special Counsel for Immigration-Related Discrimination," the Programmers Guild said in a statement, but did not identify the companies which had placed such ads. The complaints allege that the companies have discriminated against US workers in job postings that express preference towards hiring foreign workers on H-1B visas. Under the Immigration and Nationality Act, it is illegal to discriminate against US workers on the basis of immigration status, Programmers Guild pointed out. "Abuse of the H-1B programme has become so widespread that companies apparently feel free to engage openly in the practice. And we are only reviewing ads for computer programmers," Mr John Miano, founder of the Programmers Guild, said. Mr Miano, who is filing the complaints, has cited examples from actual postings on various Web sites where certain employers have gone to the extent of advertising for "H-1B From India - Multiple positions" or seeking "candidates for H-1B from India."
