THE Central Board of Direct Taxes (CBDT) made it clear on Monday that the Income Tax Department had appointed Ms Nalini Chidambaram as a special counsel only for the first case of the batch of cases that was disposed of by the Madras High Court by a judgment on April 29, 2005.
A release issued here by CBDT said that the first case of this batch was the Commissioner of Income Tax vs Janakiram Mills Ltd. "It is in the first case that a special counsel was engaged. In all other cases, the Standing counsel represented the I-T Department. The judgment also discusses only the first case, because the judgment in the first case will apply to all other cases," the release added.
The CBDT said that in the batch of cases, 43 textile mills were concerned. Among these 43 cases, the name of Karpagambal Mills Ltd, Cholapuram does not figure. "The allegation made in this behalf is totally incorrect," the CBDT added.
