The Hindu Business Line : New judge assigned for Birla will case

THE application by the Lodhas challenging the authority of the Birlas in the matter of probating the controversial last will and testament of late Priyamvada Birla, widow of M.P. Birla, after Mr Justice S.K. Mukherjee of the Calcutta High Court had declined to take up the matter on personal grounds on Monday, has been re-assigned on Tuesday.

Informed court sources said it has been assigned before the court of Mr Justice Kalyan Jyoti Sengupta. The matter, sources say, is likely to come up for hearing either tomorrow or on Thursday.

While everyone is expecting a long drawn-out court battle over the will, sources close to the law firms of Birlas and the Lodhas, however, feel that after the initial burst which may last for a month or so, the warring parties are likely to go in for an out-of-court settlement.

A veteran lawyer practising at the court opined that even in the case of a clean will, a normal probate process takes between 6 and 8 months. And this case, where the Birlas have vowed not to rest till the properties are vested with the trusts, as desired by M.P. Birla, may see many twists and turns.
