Dr Reddy's to challenge US court's verdict

HYDERABAD, Oct. 16

DR Reddy's Laboratories Ltd, the Hyderabad-based pharma major that suffered a setback on Friday with the US federal court's judgment against its battle on Astra Zeneca's patents on Prilosec (Omeprazole), has announced its decision to contest the court's verdict pertaining to two formulation patents.

Dr Reddy's is one of the four generic drug-makers that challenged the patents of Astra Zeneca in the US courts. Astra Zeneca sued these four generic drug-makers alleging infringement patents of Omeprazole drug - Prilosec, which recorded a total sales of $5.7 billion globally and $4-billion in the US market alone during 2001.

While Merck, Andrx Group and Dr Reddy's lost the case, the courts held that Schwarg Pharma did not infringe the patents of Astra Zeneca. "The three generic drug-makers have infringed the patents," the US court judge, Ms Barbara Jones, said.

In a press release here, Dr Reddy's said it would appeal against the court in the Omeprazole patent infringement trial, which ruled that the formulation patents 230 and 505 were valid.
