Courts/Legal Issues NJMC petition against tribunal award rejected Our Legal Correspondent
KOLKATA, Feb. 20 THE Calcutta High Court has dismissed the writ petition of National Jute Manufacturers Corporation Ltd (NJMC), challenging the award of the National Tribunal adjudicating under Section 10 (1A) of the Industrial Dispute Act, 1947. The said section concerns the moot point of equal pay for equal work and granting of pay-scale and other benefits to the clerical staff and subordinate staff working at different mills under NJMC, a Government of India undertaking, as per the scheme framed by the corporation under the Service Rules and Regulations, 1982 and given effect from April 1, 1988. The NJMC Staff Association preferred a reference, asking for grant of pay-scale and other benefits to the clerical and subordinate staff working at different mills under NJMC at par with the corresponding staff working in the head office, in terms of the principle of equal pay for equal work. Some other institutions having similar problem applied to be added as party in the said reference. It is stated that by the Jute Corporation Notification Act, 1980, NJMC was nationalised and by the strength of the Act, NJMC can keep the corporate office here for which the India Jute Manufacturers Association, the pre-nationalised outfit, had no objection. The counsel for the association argued before the tribunal that the staff and workers shall be treated equally as of head office staff and workers, and that there should not be any discrimination. This was controverted by the counsel of NJMC. After hearing, the tribunal had rejected the plea of NJMC and upheld the contentions of the union. Against this order, NJMC filed a writ petition in the high court, which also was rejected.
